It could be. There was a student in my school who used the schools trademark title "RIT" in one of his sites that allowed online trading of books for students, and he got into really big trouble. You can read the whole issue here:

Yes this is a trademarked domain, but its not illegal - just don't be surprised if Apple want it back.

what i think after my studies...
if the name ipodtouch helped you out to sale a product on your site or help you out geting ANY revenue with your site than IT IS ILEGAL.
you are in NO way allowed to use an other brands name for your sales.... there is this issues with Ghetta or Gettha you know the DJ wich created F*CK ME IM FAMOUSE.. well an other store used the Fme.. thing to sale other products of his... and got F because they used someone elses name to sale their products...
well its hard to explain ONE because this comes from my law teacher... second because i am french and traducing is hard :
BUT : if buyipodtouch.net is going to sale ipods especialy the touch i guess Apple not gonna like it :/ and they gonna have pretty good rights over it...
